COMFORT CAPTURE PHOTOGRAPHY TOURS AND WORKSHOPS

TERMS AND CONDITIONS

1. Introduction

1.1 These Terms and Conditions govern all photography tours, workshops, expeditions and travel experiences organised by Comfort Capture Pte. Ltd. (“Comfort Capture”, “we”, “our” or “us”).

1.2 Comfort Capture organises photography experiences in partnership with selected local operators, guides, accommodation providers, transportation suppliers and other service providers.

1.3 These Terms and Conditions form part of the booking agreement between Comfort Capture and each participant (“Participant”, “you” or “your”).

1.4 By making a booking and payment, you acknowledge that you have read, understood and agreed to these Terms and Conditions.


2. Booking and Payment

2.1 A booking is confirmed only upon:

(a) Receipt of the required deposit or full payment; and

(b) Acceptance of these Terms and Conditions.

2.2 The deposit amount and payment schedule for each tour or workshop will be stated in the relevant tour information or invoice.

2.3 The balance payment must be received by the stated due date.

2.4 Failure to make payment by the due date may result in cancellation of the booking and forfeiture of any deposit paid.

2.5 All prices are quoted in Singapore Dollars (SGD) unless otherwise specified.

2.6 Participants are responsible for any bank charges, currency conversion fees, transfer fees, credit card charges or other transaction costs.

2.7 Comfort Capture reserves the right to adjust pricing before booking confirmation in the event of significant supplier cost increases, currency fluctuations or government-imposed charges.


3. Cancellation by Participant

3.1 All cancellation requests must be submitted in writing.

3.2 Unless otherwise stated for a specific tour:

3.3 Any approved refund will be processed within a reasonable period after confirmation of eligibility.

3.4 No refund shall be provided for unused services, missed activities, early departures or late arrivals.


4. Cancellation or Changes by Comfort Capture

4.1 Certain tours require a minimum number of participants to operate.

4.2 Comfort Capture reserves the right to cancel, postpone or reschedule a tour where minimum participant numbers are not met.

4.3 Where a tour is cancelled by Comfort Capture before commencement, participants may choose:

(a) A refund of monies paid to Comfort Capture; or

(b) Transfer of payments to another Comfort Capture tour, subject to availability.

4.4 Comfort Capture shall not be responsible for consequential costs incurred by participants, including flights, visas, travel insurance, equipment rental or personal travel arrangements.


5. Changes to Itinerary

5.1 Photography tours are subject to weather conditions, road conditions, transportation schedules, local regulations, tides, wildlife activity, seasonal conditions and other operational considerations.

5.2 Comfort Capture reserves the right to modify, substitute, postpone or cancel any activity, accommodation, transportation arrangement, guide or location where reasonably necessary.

5.3 Where practical, suitable alternatives will be arranged.

5.4 Such changes shall not constitute a breach of contract and shall not entitle participants to compensation unless required by law.


6. Travel Documents and Entry Requirements

6.1 Participants are solely responsible for obtaining and maintaining valid passports, visas, permits, vaccination certificates and other travel documentation required for the tour.

6.2 Comfort Capture is not responsible for any loss, delay, cancellation or expense arising from a participant’s failure to obtain or maintain the necessary documentation.

6.3 Any refusal of entry, deportation, quarantine order or immigration decision shall be the sole responsibility of the participant.


7. Independent Suppliers

7.1 Comfort Capture carefully selects local operators, accommodation providers, transportation providers, guides and other suppliers.

7.2 Many services included within a tour are provided by independent third parties over whom Comfort Capture does not exercise direct control.

7.3 While Comfort Capture exercises reasonable care in selecting suppliers, Comfort Capture shall not be responsible for the acts, omissions, negligence, insolvency, delays, failures or defaults of independent third-party suppliers except where liability cannot be excluded by law.


8. Safety Commitment

8.1 Participant safety is a priority.

8.2 Comfort Capture reserves the right to modify, postpone, replace or cancel any activity where reasonable safety concerns arise.

8.3 Participants must comply with all instructions issued by Comfort Capture, tour leaders, guides, transportation operators and accommodation providers.

8.4 Failure to comply with safety instructions may result in removal from the activity or tour without refund.


9. Travel Insurance

9.1 Comprehensive travel insurance is mandatory for all participants.

9.2 Insurance coverage should include:

(a) Medical expenses;

(b) Emergency evacuation and repatriation;

(c) Trip cancellation and interruption;

(d) Personal liability;

(e) Loss, theft or damage of photography equipment and personal belongings.

9.3 Participants are solely responsible for arranging and maintaining appropriate insurance coverage.


10. Health and Fitness

10.1 Participants are responsible for ensuring that they are medically fit to participate.

10.2 Participants must disclose any medical condition, injury, mobility limitation, allergy or dietary requirement that may affect participation.

10.3 Comfort Capture reserves the right to decline or restrict participation where a participant’s condition may pose a risk to themselves or others.


11. Photography Activities and Equipment

11.1 Participants acknowledge that photography tours may involve:

  • Early morning departures
  • Late night photography sessions
  • Walking on uneven terrain
  • Mountain, coastal or rural environments
  • Boat transportation
  • Wildlife encounters
  • Extreme weather conditions
  • Remote locations with limited facilities

11.2 Participants are solely responsible for their photography equipment, luggage and personal belongings.

11.3 Comfort Capture shall not be liable for loss, theft, damage, malfunction or deterioration of photography equipment or personal property.

11.4 Participants are encouraged to obtain appropriate insurance for all equipment.


12. Assumption of Risk

12.1 Participants acknowledge that photography travel, outdoor activities and international travel involve inherent risks that cannot be entirely eliminated.

12.2 Such risks may include personal injury, illness, transportation incidents, adverse weather, wildlife encounters, theft, loss of property and limited access to medical services.

12.3 By participating in a tour or workshop, participants voluntarily accept these risks and agree to take reasonable responsibility for their own safety and conduct.


13. Force Majeure

13.1 Comfort Capture shall not be liable for delays, cancellations, interruptions, losses or changes resulting from circumstances beyond its reasonable control.

13.2 Such circumstances include, but are not limited to:

  • Natural disasters
  • Severe weather
  • Fire
  • Epidemics and pandemics
  • Government actions or travel restrictions
  • Civil unrest
  • Strikes
  • Terrorist acts
  • Transportation disruptions
  • Closure of attractions or destinations
  • Any other force majeure event

13.3 Comfort Capture may modify, postpone, suspend or cancel all or part of a tour where such circumstances occur.


14. Limitation of Liability

14.1 To the fullest extent permitted by law, Comfort Capture shall not be liable for any indirect, consequential, incidental or special loss, including loss of enjoyment, loss of opportunity, loss of income or loss of profits.

14.2 Comfort Capture shall not be liable for losses arising from:

(a) Weather conditions;

(b) Flight delays or cancellations;

(c) Transportation disruptions;

(d) Government restrictions or immigration decisions;

(e) Acts or omissions of third-party suppliers;

(f) Participant failure to follow reasonable instructions;

(g) Events described in Clause 13.

14.3 If Comfort Capture is found liable under applicable law, the maximum aggregate liability of Comfort Capture shall not exceed the total amount paid by the Participant for the relevant tour or workshop.

14.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.


15. Participant Conduct and Indemnity

15.1 Participants are expected to behave responsibly and respectfully throughout the tour.

15.2 Comfort Capture reserves the right to remove any participant whose conduct is unsafe, disruptive, unlawful, abusive or likely to adversely affect the experience of others.

15.3 No refund shall be payable where a participant is removed from a tour due to misconduct.

15.4 Participants agree to indemnify and hold harmless Comfort Capture, its directors, employees, contractors, guides, representatives and agents from claims, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising directly or indirectly from:

(a) Breach of these Terms and Conditions;

(b) Negligent, reckless, unlawful or wilful acts or omissions;

(c) Injury, loss or damage caused to another participant, supplier or third party;

(d) Damage to accommodation, vehicles, vessels, equipment or property;

(e) Fines, penalties, claims or legal proceedings arising from the participant’s conduct.

15.5 Participants shall reimburse Comfort Capture for reasonable costs incurred as a result of their actions or failure to comply with these Terms and Conditions.


16. Photography Results Disclaimer

16.1 Comfort Capture does not guarantee:

  • Specific photographic results
  • Wildlife sightings
  • Aurora displays
  • Weather conditions
  • Access to particular locations
  • Learning outcomes
  • Availability of specific photographic subjects

16.2 Photography outcomes depend on factors beyond Comfort Capture’s control, including environmental conditions, timing, participant skill level and local circumstances.


17. Media Release

17.1 Participants grant Comfort Capture permission to use photographs, videos and recordings captured during tours and workshops for promotional and marketing purposes.

17.2 Such use may include:

  • Website content
  • Newsletters
  • Social media
  • Advertising and promotional materials

17.3 Participants who do not wish to appear in promotional materials must notify Comfort Capture in writing before the commencement of the tour.

17.4 Copyright in photographs created by participants remains with the participant unless otherwise agreed in writing.


18. Privacy

18.1 Comfort Capture collects and processes personal information for the purposes of administering bookings, delivering services and complying with legal obligations.

18.2 Personal information will be handled in accordance with applicable privacy laws, including Singapore’s Personal Data Protection Act (PDPA).


19. Governing Law

19.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore.

19.2 Any dispute arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Singapore.
